According to a report by Heute.at, the plaintiff, who does not wish to be named, lives in a Viennese municipal building.

In 2021, a 33-year-old music student moved into the apartment above him and it wasn't long before he drew attention to himself with his love of music.

But even after a conciliatory conversation, the 33-year-old continued to practise playing the piano and guitar as well as singing opera.

"Music is all well and good, but nobody wants to be woken up at 6.30 a.m. by opera singing," said the Viennese in an interview with the newspaper.

This was finally followed by a complaint in January 2024, which went all the way to the Administrative Court. The verdict was finally announced in November last year: 700 euros in damages.

But this amount is not enough for Wiener. He wants to go back to court and sue his landlord once again for damages and an injunction.
